Criminal Offences

There are two kinds of criminal offences that companies, company directors and other individuals can commit in relation to deaths and injuries resulting from corporate or organisational activities:
  • Regulatory Offences
    These are offences either contained in legislation that has been passed by Parliament (i.e. the Health and Safety at Work Act 1974, Factories Act 1961, Merchant Shipping Act 1998) or Regulations that have been made by an order of a Minister under powers provided by legislation (i.e. Management at Work Regulations 1999.

  • Conventional Crimes of Violence
    The only 'conventional crime of violence' that is currently considered to apply in the health and safety arena is the offence of manslaughter.
