Conviction of Directors: 1 April 2002 - 31 Marcdh 2003
In 2002/3, 11 directors were convicted for health and safety offences. Two are known to have involved deaths. Noone faced imprisonment. The average fine was £5795

Summary Worker fell through fragile cement roof sheeting while replacing valley gutter. Safety net on site but not used. MD of company on site before and at time of accident but failed to take any action. Workers had not seen method statement.

Summary ”This case relates to a fatality to a roofwork employee of the accused company engaged in the repair of the roof of an industrial warehouse. There were no guardrails on the roofing boards from which employees were working and neither were fall protection harnesses used. The system of work was not safe. The deceased fell through the fragile roof material.”

Summary ”Mr Nahal is a Director of Skyglass Limited He was the company officer responsible for ensuring that the Notices served on the company were complied with. In particular, IN requiring electrical wiring to be checked and repaired was not complied with, IN requiring extraction to be provided for welding fume was not complied with and PN prohibiting further spraying of carcinogenic paint containing zinc tetroxy chromate was not complied with. Evidence collected indicates that paint had continued to be sprayed on several occassions after PN was served without additional controls.”

Construction work was being undertaken in an unsafe manner in that the working platform in use did not comply with the requirements of the Regulations; there were excavations open with no precautions to prevent a person falling into them and no hot or warm water on site. The Prohibition Notice served on 13/12/01 in relation to the use of cement was not complied with.”
