Enforcement Notices - Informing the Board

Paragraph 20 of HSC's Enforcement Policy Statement says:

When inspectors issue improvement or prohibition notices; withdraw approvals; vary licence conditions or exemptions; issue formal cautions; or prosecute; enforcing authorities should ensure that a senior officer of the duty holder concerned, at board level, is also notified.

However, HSE's Enforcement Guide states tells inspectors that this requirement only applies in certain limited circumstances. It states that

Where there is a history of non-compliance, or extensive resources are required to comply with a notice, you should ensure that a copy is brought to the attention of an appropriate senior manager or director. In the event of non-compliance this may assist in a prosecution of that person under section 37 of the HSWA.
